NOTICE OF PUBLIC HEARING

 

The Bristol Township Council will conduct a Public Hearing on Thursday, January 21, 2021 at 7:00 p.m. via virtual meeting to consider the enactment of the following Ordinance:

 

ORDINANCE 2021-

 

AN ORDINANCE OF THE TOWNSHIP OF BRISTOL CHANGING THE ZONING CLASSIFICATION OF PROPERTIES IDENTIFIED AS TAX MAP PARCELS #05-018-066 AND #05-018-066-001 FROM R-1 RESIDENTIAL TO P-I PLANNED INDUSTRIAL

 

WHEREAS, the Township of Bristol is a municipality located in the County of Bucks, Commonwealth of Pennsylvania and organized and existing pursuant to the Pennsylvania First Class Township Code; and

WHEREAS, the Council of the Township of Bristol is empowered to adopt Ordinances of the Township pursuant to the Pennsylvania First Class Township Code, 53 P.S. § 56502; and

WHEREAS, the Council of the Township of Bristol, Commonwealth of Pennsylvania is authorized to enact a zoning ordinance to permit, prohibit, regulate, restrict or determine the use of land or structures pursuant to the Pennsylvania Municipalities Planning Code Act, 53 P.S. § 10603; and

WHEREAS, the Council of the Township of Bristol adopted a comprehensive Zoning Ordinance which became effective on October 1, 2002; and

WHEREAS, the Council of the Township of Bristol is empowered under the Municipalities Planning Code to amend the Zoning Map and change the zoning classification of property within the Township of Bristol; and

WHEREAS, pursuant to Section 609 of the Municipalities Planning Code, Pine View Estates, LLC has requested the Council of the Township of Bristol to change the zoning classification of Tax Map Parcels #05-018-066 and #05-018-066-001 from R-1 Residential to P-I Planned Industrial; and

WHEREAS, the proposed zoning change has been submitted and reviewed by the Bucks County Planning Commission and the Bristol Township Planning Commission in accordance with the Pennsylvania Municipalities Planning Code; and

WHEREAS, after a properly advertised public hearing, the Council finds the requested zoning change to be reasonable and in conformity with contiguous and surrounding properties.

NOW, THEREFORE, the Council of Bristol Township, Bucks County, Pennsylvania does hereby ordain and enact the following:

SECTION 1. Tax Map Parcel No. 05-018-066 located at Newportville Road in Bristol Township, Pennsylvania is rezoned to P-I Industrial.

SECTION 2.  Tax Map Parcel No. 05-018-066-001 located at Newportville Road in Bristol Township, Pennsylvania is rezoned to P-I Industrial.

SECTION 3.  The Zoning Map of the Township of Bristol shall be changed, corrected and marked in accordance with the provisions of this Ordinance so that the same shall show the above described properties of the Township of Bristol to be classified for zoning purposes as P-I Planned Industrial.

SECTION 4.  The provisions of this Ordinance are severable.  If any section, clause, sentence, part or provision hereof shall be held illegal, invalid or unconstitutional by any court of competent jurisdiction, such decision of the court shall not affect or impair any of the remaining sections, clauses, sentences, parts or provisions of this Ordinance.  It is hereby declared to be the intent of Council that this Ordinance would have been adopted if such illegal, invalid or unconstitutional section, clause, sentence, part or provision had not been included herein.

SECTION 5.  All Ordinances or parts of Ordinances not consistent herewith are hereby amended and/or repealed to the degree they are in conflict with this Ordinance.

SECTION 6.  The appropriate Township Representatives and Officials are hereby authorized to execute any and all documents to carry out the intent and purpose of this Amendment.

SECTION 7.  This Ordinance shall become effective ten (10) days after its final passage by the Council of Bristol Township.

ORDINANCE NO.  2021 -

AN ORDINANCE OF THE TOWNSHIP OF BRISTOL, BUCKS COUNTY, PENNSYLVANIA AMENDING SCHEDULE XVIII (Section 191-82) OF CHAPTER  191, VEHICLES AND TRAFFIC, OF THE BRISTOL TOWNSHIP CODE OF ORDINANCES TO AUTHORIZE NO PARKING FOR VEHICLES PARKED 75 FEET WITHIN THIRD DISTRCIT FIRE COMPANY DRIVEWAYS AND 65 FEET ON HARRISON STREET FROM BATH ROAD.

WHEREAS, the Council of the Township of Bristol is empowered to adopt Ordinances of the Township pursuant to the Pennsylvania First Class Township Code, 63 P.S. Section 56502; and

WHEREAS, pursuant to Section 1502(49) of the First-Class Township Code, 53 P.S. §56501-56590 and Chapter 191, Section IV of the Bristol Township Code of Ordinances, Bristol Township has the right to regulate parking; and

WHEREAS, the Council for the Township of Bristol has determined that it is necessary to prohibit parking within seventy-five (75) feet within Third District Fire Company Driveways and sixty-five (65) feet on Terrace Street from Bath Road to provide clearance for Emergency Fire Trucks; and

NOW, THEREFORE, the Council of Bristol Township, Bucks County, Pennsylvania does hereby ordain and enact the following:

Section 1.  Chapter 191, Article IV Parking Regulations, of the Code of the Township of Bristol is hereby amended by the addition of the seventy-five (75) feet within Third District Fire Company Driveways on both Harrison and Terrace Streets and sixty-five (65) feet on Terrace Street from Bath Road to the list of streets with prohibited parking in Section 191-79,  Schedule XV: Parking Prohibited at All Times.

Section 2. Consistent with the above amendment, Section §191-79, Schedule XV: Parking Prohibited at All Times is hereby amended by the addition of the language below and will read as follows:

Section 3. Whenever the requirements of this Ordinance are in conflict with other requirements of the Ordinances of the Township of Bristol, the most restrictive, or those imposing the higher standards, shall govern.

Section 4. The provisions of this Ordinance are severable. If any section, clause, sentence, part or provision hereof shall be held illegal, invalid or unconstitutional by any court of competent jurisdiction, such decision of the court shall not affect or impair any of the remaining sections, clauses, sentences, parts or provisions of this Ordinance. It is hereby declared to be the intent of the Council of Bristol Township that this Ordinance would have been adopted if such illegal, invalid or unconstitutional section, clause, sentence, part or provision had not been included herein.

Section 5.  This Ordinance shall become effective immediately.
